These Terms & Conditions (the "Terms") govern your access to and use of the ARKA Botanics website at arkabotanics.com (the "Site") and your purchase of ARKA Botanics products (the "Products"). The Site and Products are operated by Pontello Brands Pte Ltd ("ARKA Botanics", "we", "us", or "our"). By accessing the Site, placing an order, or purchasing a Product, you confirm that you have read, understood, and agreed to these Terms.

We may update these Terms from time to time to reflect changes in our products, the law, or our operating practices. The version published on the Site at the time you place an order applies to that order. Your continued use of the Site after any update constitutes acceptance of the revised Terms.

You must be at least 18 years of age and able to form a legally binding contract to purchase from us. By placing an order, you represent that you meet these requirements and that the information you provide is accurate and complete. Products are intended for personal, non-commercial use unless otherwise agreed in writing. We do not permit resale of our Products without our prior written authorisation.

ARKA Botanics offers two product lines: daily capsule supplements — Vital Flow Essentials (metabolic and blood sugar support), Mind Boost Essentials (cognitive support), and Pulse Protec Essentials (cardiovascular support) — and functional vinegar tonics — Metabolic Support Restorative Vinegar (honey vinegar, for digestion and weight management), Revitalizing Restorative Vinegar (longan, for sleep and calm), and Immunity Boost Restorative Vinegar (sea buckthorn, for immunity). Our Products are botanical-based functional supplements and tonics intended as part of a healthy lifestyle.

ARKA Botanics products are functional food and supplement products, not medicines or drugs. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The statements regarding our products have not been evaluated by any medical or drug regulatory authority. Our products are not a substitute for a balanced diet, professional medical advice, diagnosis, or treatment. If you are pregnant, nursing, taking medication, managing a medical condition, or have known allergies, consult a qualified healthcare professional before use. Discontinue use and seek advice if any adverse reaction occurs. Keep out of reach of young children. Individual results may vary.

Product descriptions, ingredient lists, and traditional-use information are provided for general information only. You are responsible for reading the label, ingredient, and allergen information on each Product before use, and for ensuring the Product is suitable for you. Where a Product is described as carrying Halal certification or as being suitable for vegetarian or Sattvic diets, that description applies only to the markets and batches for which such certification or formulation has been confirmed, as stated on the Product label or Site.

We take care to describe and price Products accurately. However, errors may occasionally occur. Prices are shown in the applicable local currency for your market and are inclusive or exclusive of taxes as indicated at checkout. Delivery charges, where applicable, are shown separately before you confirm your order.

We may change prices, withdraw Products, or limit order quantities at any time without notice. If we discover a material error in the price or description of a Product after you order, we will contact you to confirm whether you wish to proceed at the correct price or cancel the order, and we will refund any amount already paid if you cancel.

Product images, colours, and packaging are for illustration; actual packaging and batch details may vary. We sell only quantities reasonable for ordinary personal use.

Your order is an offer to purchase. After you place an order, we will send an acknowledgement confirming receipt. A binding contract is formed only when we confirm dispatch of the Products. We may decline or cancel an order at our discretion — for example, where Products are unavailable, where we suspect fraud or resale, where a pricing error has occurred, where delivery is not available to your location, or where acceptance would breach applicable law. Where we cancel a confirmed order, we will refund any payment received for the cancelled items.

Payment is taken through the payment methods offered at checkout via our third-party payment providers. You confirm that you are authorised to use the payment method selected. We do not store full payment-card details; these are processed securely by our payment providers. Title to the Products remains with us until we have received payment in full. Risk in the Products passes to you on delivery.

Delivery timelines, charges, and coverage are set out in our Shipment Policy. Returns, replacements, refunds, and cancellations are governed by our Return & Refund Policy. Both policies form part of these Terms. Because our Products are ingestible food and supplement products, returns are accepted only on a limited, hygiene-based basis as described in the Return & Refund Policy.

You agree to use the Site lawfully and not to:

• Misuse, disrupt, or attempt to gain unauthorised access to the Site or its systems;
• Copy, scrape, or republish Site content without permission;
• Submit false information or impersonate another person; or
• Upload any content that is unlawful, misleading, infringing, or harmful.

We may suspend or terminate access to any user who breaches these Terms.

All content on the Site — including the ARKA and ARKA Botanics names and logos, product names, text, graphics, packaging design, and photography — is owned by or licensed to us and is protected by intellectual property laws. You may view and use the Site for your own personal, non-commercial purposes only. No content may be reproduced, distributed, or used commercially without our prior written consent.

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use. We may suspend or close accounts that are inactive, used in breach of these Terms, or involved in unlawful or fraudulent activity. Closing an account does not affect orders or obligations already in progress.

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential loss, or for loss of profit, data, or goodwill, arising from your use of the Site or Products. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud, or for any statutory rights granted to consumers that cannot be waived. Subject to the foregoing, our total liability in connection with any order shall not exceed the amount you paid for the Products in that order.

Our Products are intended to be used as directed on the label. We are not responsible for adverse effects arising from misuse, use contrary to label instructions, use despite a known allergy or contraindication, or use without appropriate professional advice where advised.

Nothing in these Terms affects any rights you have as a consumer under the mandatory consumer-protection laws applicable in your market, including rights relating to products that are defective, unsafe, or not as described. These Terms are in addition to, and do not override, those rights.

We process personal data in accordance with our Privacy Policy, which forms part of these Terms and explains how we collect, use, share, and protect your information and the rights available to you.

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, transport or supply disruptions, failures of third-party carriers or payment providers, or acts of public authorities.

These Terms are governed by the laws applicable at the place of the Company's registration (Singapore). Any dispute arising from these Terms or your use of the Site or Products shall first be addressed through good-faith discussion with our customer care team. Disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts at the Company's registered office, without prejudice to any mandatory consumer-protection forum available to you under applicable law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with the Privacy Policy, Return & Refund Policy, and Shipment Policy, constitute the entire agreement between you and us regarding the Site and Products and supersede any prior understanding.
